Legal basis for processing
Art. 6 par. 1 sentence 1 lit. a GDPR serves as the legal basis for our company for processing operations in which we obtain consent for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which the data subject is party, as is the case, for example, with processing operations necessary for the delivery of goods or the provision of other services or consideration, the processing is based on Art. 6 par. sentence 1 lit. b GDPR. The same applies to processing operations that are necessary for the implementation of pre-contractual measures, for example in cases of enquiries about our products or services. If our company is subject to a legal obligation that requires the processing of personal data, such as for the fulfilment of tax obligations, the processing is based on Art. 6 par. sentence 1 lit. c GDPR. In rare cases, the processing of personal data may be necessary to protect the vital interests of the data subject or another natural person, Art. 6 par. sentence 1 lit. d GDPR. Ultimately, processing operations could also be based on Art. 6 par. sentence 1 lit. f GDPR. This legal basis applies to processing operations that are not covered by any of the above legal bases, if the processing is necessary to safeguard a legitimate interest of our company or a third party, provided that the interests, fundamental rights and freedoms of the data subject do not prevail.
Transfer of data
Your personal data will not be transferred to third parties for purposes other than those listed below. We will only disclose your personal data to third parties if:
- you have given your express consent to this in accordance with Art. 6 par. 1 sentence 1 lit. a GDPR,
- the transfer is necessary for the establishment, exercise or defence of legal claims pursuant to Art. 6 par. 1 sentence 1 lit. f GDPR and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data,
- in the event that there is a legal obligation to disclose information in accordance with Art. 6 par. 1 sentence 1 lit. c GDPR, and
- this is legally permissible and necessary for the performance of contractual relationships with you in accordance with Art. 6 par. 1 sentence 1 lit. b GDPR.
Notice on cookies
In this policy, we explain what cookies are, what types of cookies we use, and how you can manage your cookie settings.
What are cookies?
Cookies are small text files that are stored on your device (computer, tablet, smartphone, etc.) when you visit our website. These files store certain information about your device and your preferences and enable the website to recognise you when you visit again.
Similar technologies such as pixel tags, web beacons or local storage are used for similar purposes.
Legal basis for the use of cookies in Germany
The legal basis for setting cookies in Germany is divided into two parts:
Essential cookies: No active consent is required for cookies that are technically necessary to provide you with the services you have expressly requested (e.g. language selection, shopping basket, login function). The legal basis here is generally Section 25 par. 2 no. 2 TTDSG in conjunction with Art. 6 par. 1 lit. f GDPR (legitimate interest).
Non-essential cookies: For all other cookies (e.g. analytics, marketing, convenience), your explicit and informed consent is required (opt-in). The legal basis is Section 25 par. 1 TTDSG in conjunction with Art. 6 par. 1 lit. a GDPR (consent).
Types of cookies we use
We use different types of cookies for different purposes. The exact list of cookies used on our website, their storage period and the respective provider are displayed in our cookie consent tool (consent banner) and in the detailed view.
Technically necessary cookies (always active)
These cookies are essential for the basic functioning of our website, e.g. navigation, display of content or ensuring IT security. Without them, the website could not be used or could only be used to a limited extent. They cannot be disabled.
- Examples: Session cookies for the login area (if applicable), cookies for storing your cookie settings.
Analysis and statistics cookies (consent required)
These cookies help us understand visitor behaviour by collecting and analysing anonymous information. They enable us to measure and improve the performance of our website, for example by determining which pages are most popular.
- Examples: Cookies for Google Analytics, Matomo or other analytics tools.
Marketing and third-party cookies (consent required)
These cookies are used to show visitors relevant advertisements on other websites. They track visitors across websites to build a profile of their interests and carry out targeted marketing activities (e.g. retargeting). This also includes cookies from social media platforms if these are integrated into our website.
- Examples: Cookies for LinkedIn, YouTube (video embeds), Google Ads, HubSpot.
Managing your cookie settings
You can control your cookie settings at any time.
- About the cookie consent tool: You can revoke or change your consent when you first visit our website or at any time via the link [Usercentrics button at the bottom left (fingerprint) of the website]. You can opt out of the use of analytics and marketing cookies or select individual categories.
- About your browser: You can also manage, block or delete cookies via the settings of your web browser (e.g. Chrome, Firefox, Edge). Please note that disabling technically necessary cookies may severely limit the functionality of our website.
Data transfer to third countries (e.g. USA)
Insofar as we use cookies from providers whose headquarters are located outside the European Economic Area (EEA) (e.g. the USA, where there is no level of data protection comparable to that in the EU) and which can be accessed by local authorities, your personal data will only be transferred if you have given us your express consent via the cookie consent tool.
Rights of data subjects
You have the right:
- pursuant to Art. 15 GDPR, to request information about your personal data processed by us. In particular, you can obtain information about the purposes of processing, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, deletion, restriction of processing or objection, the existence of a right to lodge a complaint, the origin of your data if it was not collected by us, and the existence of automated decision-making, including profiling and, where applicable, meaningful information about its details;
- pursuant to Art. 16 GDPR, to request the immediate correction of inaccurate or incomplete personal data stored by us;
- pursuant to Art. 17 GDPR, to request the erasure of your personal data stored by us, unless processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for the establishment, exercise, or defence of legal claims;
- pursuant to Art. 18 GDPR, to request the restriction of the processing of your personal data, insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you refuse to have it deleted and we no longer need the data, but you need it to assert, exercise or defend legal claims, or you have lodged an objection to the processing pursuant to Art. 21 GDPR;
- pursuant to Art. 20 GDPR, to receive your personal data that you have provided to us in a structured, commonly used and machine-readable format or to request its transfer to another controller;
- pursuant to Article 22 GDPR, not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you;
- pursuant to Art. 7 par. 3 GDPR, to revoke your consent at any time. As a result, we are no longer permitted to continue processing data based on this consent in the future and
- pursuant to Article 77 GDPR, you have the right to lodge a complaint with a supervisory authority, without prejudice to any other administrative or judicial remedy. As a rule, you can contact the supervisory authority of your usual place of residence or workplace or the place of the alleged breach if the data subject believes that the processing of personal data concerning them violates the EU General Data Protection Regulation (GDPR).
